Terms and Conditions

1. Introduction

Welcome to Aureva (“the Platform”). These Terms and Conditions govern your use of the Platform, which allows retail investors to buy and sell bullion. By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform.

2. Eligibility

2.1. To use the Platform, you must be at least 18 years old and legally capable of entering into a binding contract.
2.2. You must be a resident of Malaysia or comply with all applicable laws in your jurisdiction.

3. Know Your Customer (KYC) Requirements

3.1. To comply with Malaysian laws, including the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA), you are required to provide authentic and valid documents for KYC purposes.
3.2. Acceptable documents include, but are not limited to:

  • A copy of your National Identification Card (MyKad) or passport.

3.3. The Platform reserves the right to verify the authenticity of the documents provided and may reject your application if the documents are incomplete, invalid, or fraudulent.

4. Buying Bullion

4.1. The Platform sells bullion to retail investors at the prevailing market price, plus any applicable fees or charges.
4.2. Upon purchase, you will receive a certificate of ownership or invoice detailing the bullion’s serial number, weight, purity, and other relevant information.
4.3. Ownership of the bullion will only transfer to you upon full payment of the purchase price.

5. Selling Bullion Back to the Platform

5.1. The Platform only buys back bullion that it has originally sold.
5.2. To sell bullion back to the Platform, the serial number of the bullion must match the records in our system.
5.3. The buyback price will be determined by the prevailing market price at the time of the transaction, minus any applicable fees or charges.
5.4. The Platform reserves the right to inspect the bullion before completing the buyback transaction.

6. Delivery and Pickup

6.1. The Platform offers both delivery and in-person pickup options for purchased bullion.
6.2. For delivery services:

  • Delivery is available only within Malaysia.
  • Delivery fees will be calculated based on your location and the value of the bullion.
  • The Platform uses insured delivery services; however, risk transfers to you upon delivery.
  • You must provide accurate delivery information to avoid delays or failed deliveries.

6.3. For in-person pickup:

  • You must schedule an appointment via the Platform.
  • Pickup is available only at our designated locations during business hours.
  • You must present valid identification that matches your KYC records.
  • The Platform reserves the right to refuse pickup if proper identification cannot be verified.

7. Payment Terms

7.1. All payments must be made in Malaysian Ringgit (MYR) through the payment methods specified on the Platform.
7.2. The Platform is not responsible for any delays or errors caused by third-party payment processors.

8. Intellectual Property

8.1. All content on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Aureva or its content suppliers and is protected by Malaysian and international copyright laws.
8.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform without our prior written consent.
8.3. The Aureva name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Aureva or its affiliates. You may not use such marks without our prior written permission.

9. Limitation of Liability

9.1. The Platform shall not be liable for any loss or damage arising from:

  • Your failure to provide accurate or authentic documents for KYC purposes.
  • Any changes in the market value of bullion.
  • Any delay or failure in processing transactions due to circumstances beyond our control.

9.2. The Platform’s total liability to you shall not exceed the total amount paid by you for the bullion purchased.

10. Privacy Policy

10.1. Your personal information will be collected, used, and stored in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (PDPA).
10.2. By using the Platform, you consent to the collection and processing of your personal data for KYC and other legitimate business purposes.

11. Amendments to Terms and Conditions

11.1. The Platform reserves the right to amend these Terms and Conditions at any time.
11.2. You will be notified of any changes, and your continued use of the Platform constitutes acceptance of the amended terms.

12. Governing Law and Dispute Resolution

12.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
12.2. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved through negotiation, mediation, or arbitration in Malaysia.

13. Termination

13.1. The Platform reserves the right to terminate or suspend your account at any time, without prior notice, if you breach these Terms and Conditions or engage in fraudulent or unlawful activities.
